What information do we collect?

How do we protect your information?

WARRANTY AND LIMITATION OF LIABILITY

Subject to the limitations below, Stop the Mold NY warrants its products to be free from defects in materials or workmanship under normal usage for one (1) year after original purchase date. Provided that the defective product is returned to Stop the Mold NY during the warranty period, postage pre-paid, together with valid, dated proof of purchase, Stop the Mold NY will, at its sole option, repair or replace the defective product free of charge or refund the original purchase price less shipping costs. This warranty extends only to the original purchaser and is not transferable. This warranty does not cover defects resulting from (a) commercial use; (b) normal wear and tear; improper use, maintenance or storage; or misuse, accidents or neglect. Stop the Mold NY makes no warranty for products modified by the buyer or subject to misuse or neglect.

WHERE PERMITTED, THE PROVISIONS OF THIS LIMITED WARRANTY ARE THE COMPLETE AND EXCLUSIVE STATEMENT OF WARRANTY WHICH Stop the Mold NY PROVIDES AND ARE IN LIEU OF ANY OTHER WRITTEN WARRANTY, WHETHER EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WILL BE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. Notwithstanding the above, where applicable, if you qualify as a “consumer” under the Magnuson-Moss Warranty Act, then you may be entitled to any implied warranties allowed by law for the period of the express Limited Warranty as stated above. Some states do not allow limitations on how long an implied Limited Warranty lasts, so the above limitation may not apply to you.

IN NO EVENT, WILL Stop the Mold NY BE LIABLE FOR ANY LOSS OF USE, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, LOST PROFITS OR SAVINGS, OR OTHER INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT, TO THE FULL EXTENT SUCH MAY BE DISCLAIMED BY LAW. IN NO EVENT WILL Stop the Mold NY’S LIABILITY EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT. Some states and jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, and thus, the limitations on damages may not apply to you. This warranty gives you specific legal rights, and you may have other rights which vary from state to state.

Stop the Mold NY DOES NOT PROVIDE ANY WARRANTY COVERAGE UNLESS CLAIMS ARE SUBMITTED AS FOLLOWS: To request warranty service, contact Stop the Mold NY via the contact information at www.stopthemoldny.com. If Stop the Mold NY determines that a repair or replacement is required, you will be asked to provide your name, address, phone number, email, and order number. Products returned to Stop the Mold NY must be properly packaged, with the delivery charges prepaid via a shipping method that provides for tracking of your package, to our mailing address. A product confirmed as defective (as described in the Stop the Mold NY warranty) may be replaced with an identical item or, if the item is no longer available, with a comparable product or refund of original purchase price less shipping costs. All costs associated with the shipment of the product are your responsibility.

IN ADDITION, TO THE PRODUCT LIMITED WARRANTY AND LIABILITY, Stop the Mold NY SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR Stop the Mold NY SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THIS WEB SITE OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF Stop the Mold NY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS IS INAPPLICABLE.

SWEEPSTAKES AND CONTEST POLICY

To provide fair and equal chance of winning to all Stop the Mold NY consumers, fans and/or followers, the following are the official rules for all online contests/sweepstakes on Stop the Mold NY websites, brand-controlled Facebook pages and brand-controlled Twitter pages.

NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

1. Entering Contests/Sweepstake and Choosing and Contacting Winners. Winners of email contests/sweepstakes will be chosen at random.

Entrants must send entries using the accurate contest/sweepstake entry name, a valid email address, and include the subject line, and any other specific entry information requested in the contest/sweepstakes announcement. Stop the Mold NY is not responsible for and will not consider incomplete or incorrect entries or emails sent or not received by Stop the Mold NY for any reason, as potential contest/sweepstake winners.

Only one entry per person/email address used to send the email will be considered for contest/sweepstakes entry, unless multiple entries are specifically allowed in the contest/sweepstakes posting. Unless otherwise specified in an individual contest/sweepstakes post, no person may enter any contest/sweepstakes more than once using multiple email addresses.

Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Stop the Mold NY’s servers or elsewhere, will not be eligible.

Stop the Mold NY in their sole discretion, reserve the right to disqualify any person suspected of tampering with the entry process, the operation of the website, or acting otherwise in violation of these Rules. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Stop the Mold NY. Stop the Mold NY is not responsible for errors in the administration or fulfillment of these contests/sweepstakes, including without limitation mechanical, human, printing, distribution, or production errors, and may modify or cancel a contest/sweepstake based upon such an error at their sole discretion, and without liability. Stop the Mold NY further reserves the right to cancel, terminate, or modify any promotion not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort. In the event of a dispute, entries will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Service Provider, online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All decisions of Stop the Mold NY are final.

Employees of Stop the Mold NY, participating companies (such as retailers, vendors, etc.), and their immediate families are not eligible.

Winners of all contests/sweepstakes will be contacted at the “sender” email address used to enter the contest/sweepstakes and the person receiving and replying to the winner announcement email will be considered the winner unless they specify another person within the reply email as the winner. Stop the Mold NY will mail the contest/sweepstakes prize to the address supplied by the recipient of the winner announcement email. The odds of winning depend on the number of entries received. All email addresses that are submitted are automatically added to receive the Stop the Mold NY monthly newsletter.

All entries become the property of Stop the Mold NY and will not be acknowledged or returned.
